A child custody lawyer will focus solely on the best interest of the child in the event of a child custody battle. Their duty is to take into consideration the right of both parents and/or legal guardians but this does not supersede the rights of the child. There are different custody agreements that can be met. Sole custody is when one parent is granted the right to care for the child indefinitely. Shared custody is when the parental rights and responsibilities of the child is shared between the parents. In previous years, a mother was granted automatic guardianship or custody of child. This was referred to as preferment parent. This notion is no longer supported. Both parents have equal rights to the child’s care. Disputes are raised when one or both parents are found unfit to care for the child. In relation to this, the Children’s Act ensures that a decision will be founded based on the child’s best interests.
